General Terms and Conditions of Sale of the Category I Tourist Office

‘BEAUNE & PAYS BEAUNOIS’

Article 1

Tourist Offices registered under the Act of 22 July 2009 may arrange bookings and sell all types of services, leisure activities and hospitality of general interest within their area of operation. They facilitate the process for the public by offering them a choice of services.

Tourist Offices are local tourism organisations, acting on behalf of service providers with whom they have entered into a service agreement.

Tourist Offices shall not be held liable in the event of these contracts being used by third parties or for purposes other than tourism.

Article 2 – Duration of the service

The customer named on the voucher (or ticket) specifying a service of a fixed duration may not, under any circumstances, claim any right to remain on the premises once the service has ended.

Article 3 – Liability

The Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’, which provides services to a customer, is that customer’s sole point of contact and is liable to them for the fulfilment of the obligations arising from these terms and conditions of sale. The Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” cannot be held liable for unforeseeable events, force majeure or the actions of any person not involved in the organisation and delivery of the service.

Article 4 – Booking

The booking becomes binding once the full price has been paid to the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ before the deadline specified on the voucher (or ticket).

Article 5 – Voucher

Upon receipt of payment for the service, the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” shall provide the customer with two copies of the voucher (or ticket), one of which must be handed over by the customer to the service provider upon arrival.

Article 6 – Arrival

The customer must arrive on the date and at the time specified on the voucher (or ticket).

If this is not possible, they undertake to notify the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS”.

In the event of a late arrival or a last-minute cancellation, the customer must notify the service provider, whose address, telephone number or email address is shown on the voucher.

Article 7 – Cancellation by the customer.

Any cancellation must be reported to the reception desk of the Category I Tourist OfficeI “BEAUNE & PAYS BEAUNOIS” on +33 (0)3 80 262 130 or by email at [email protected], quoting the order number.

The customer must obtain a cancellation reference number confirming that their cancellation has been registered.

The applicable cancellation and refund terms are as follows:

    • For leisure offers and activities: any cancellation made less than one calendar day before the date of the service (the day of the service does not count) will not give rise to any refund
    • For event tickets: any cancellation made less than three calendar days before the date of the event (the day of the event does not count) will not give rise to any refund

Should the customer fail to attend on the day of the service or event, no refund will be granted.

As an exception, a refund may be considered in the event of force majeure duly justified by the customer, in particular in the event of death, a serious accident, hospitalisation or any other unforeseeable event preventing their attendance.

The Tourist Office reserves the right to request any supporting documentation necessary to assess the request.

Article 8 – Alteration by the service provider or the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ of a substantial element of the service

Where, prior to the scheduled start date of the service, the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ is compelled to make a change to one of the essential elements of the service, the purchaser may:

    • either cancel the booking and receive, without penalty, a deferred refund of the sums paid;
    • or accept the change or substitution of service locations proposed by the seller.

Any reduction in price shall be deducted from any sums still due by the purchaser and, if the payment already made by the purchaser exceeds the price of the amended service, the overpayment shall be refunded to the customer before the service begins.

Article 9 – The seller’s inability to provide the services specified in the contract whilst the service is being provided

Where, during the provision of the service, the seller is unable to provide a substantial part of the services provided for in the contract, representing a significant percentage of the price paid by the buyer, the Cat.I ‘BEAUNE & PAYS BEAUNOIS’, without prejudice to any claims for compensation for damages that may have been suffered, shall offer an alternative service in place of the one provided for, bearing any additional cost where applicable. If the service accepted by the purchaser is of inferior quality, the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ shall reimburse the purchaser for the difference in price before the end of the service. If the seller is unable to offer a replacement service, or if the purchaser refuses it for valid reasons, the seller shall pay the purchaser compensation calculated on the same basis as in the event of cancellation by the seller.

Article 10 – Cancellation by the seller

Where, prior to the start of the service, the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ cancels the service due to the service provider’s fault, it must inform the purchaser before or at the time of departure for the service. The purchaser shall be reimbursed, as far as possible, either immediately or at a later date, for the sums paid – without any compensation.

Article 11 – Interruption of the service

In the event of the service being interrupted by the customer, no refund will be made.

Article 12 – Capacity

This voucher (or ticket) is issued for a specific number of people. If the number of participants exceeds the capacity provided for in the service, the service provider may refuse to admit any additional customers.

Article 13 – Transfer of the voucher by the customer

The purchaser may transfer their voucher to a transferee who meets the same conditions as the purchaser for the service to be provided. In this case, the purchaser is required to inform the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ before the service begins.

The transfer of the voucher (ticket) must be carried out at cost price.

The transferor and the transferee are jointly and severally liable to the seller for payment of the balance, the price and any additional costs incurred as a result of this transfer.

Article 14 – Insurance

The customer is liable for any damage caused by their own actions. They are advised to take out a standard holiday insurance policy to cover these various risks.

Article 15 – Special Terms and Conditions for Services

The specific terms and conditions for services resold by the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ are provided with the voucher (or ticket).

An insufficient number of participants may constitute valid grounds for cancellation for certain types of services.

In this case, the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ shall refund the full amount paid, to the best of its ability, either immediately or at a later date.

Article 16 – Disputes

Any complaint relating to a service must be submitted to the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ within 3 days of the start of the service.

Any other complaint relating to a service must be sent, as soon as possible, by letter, to the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS”, which has sole jurisdiction to rule on disputes.

Any dispute relating to the exclusive application of these general terms and conditions shall fall within the exclusive jurisdiction of the courts of the registered office of the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” or of the county town of its department.

Article 17 – Professional Civil Liability

The Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” has taken out professional civil liability insurance for local non-profit tourism organisations (Article 60 of Decree No. 94-490 of 15 June 1994) No. 082509/J with the following insurer:

Article 18 – Registration

The Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ is registered in the ATOUT France register of travel and holiday operators under number IM021100008.

Article 19: Confidentiality and protection of personal data

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify and object to the processing of their personal data by contacting the Category I Tourist OfficeI “BEAUNE & PAYS BEAUNOIS” at [email protected], specifying “Personal data” as the subject of the email.

Special terms and conditions for distance selling

Article 1: The order

Any order for services placed online or remotely with the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” implies unconditional and unrestricted acceptance of these specific terms and conditions for distance selling. These terms and conditions are available at any time on the website www.beaune-tourisme.fr under the heading ‘Terms and Conditions’ / https://www.beaune-tourism.com/conditions-generales-de-vente-en/.

Article 2: Terms of performance and delivery

The Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ offers its customers services provided by partner service providers.

The vouchers (or tickets) corresponding to each service are sent to the customer by email in PDF format. The service provider will ask the customer to present these vouchers (or tickets) during the visit.

These vouchers (or tickets) are valid for the period and service specified. In the event of failure on the part of one or more service providers, the Category I Tourist Office “BEAUNE & PAYS BEAUNOIS” undertakes to provide an equivalent service, without this giving rise to any entitlement to compensation; if, for any reason, one of the booked services cannot be provided or replaced (in whole or in part), the customer shall only be entitled to a refund for the service in question, to the exclusion of any damages.

Article 3: Payment

Payment for online purchases is made by credit card (Visa, Mastercard, Carte Bleue) via the secure Paybox System (https://www.paybox.com/agrements-et-certifications/). Electronic tickets in PDF format are sent by email once the order has been confirmed and payment accepted.

Article 4: Cancellation by the customer

In accordance with the Consumer Code and the provisions of Articles L121-21, the customer has a withdrawal period of 14 clear days from the date of receipt of the e-tickets, without having to provide any reason or pay any penalties. However, in accordance with Article 121-21-8, and by way of exception to Article L121-21, the customer does not have a right of withdrawal for leisure activities that must be provided on a specific date or during a specific period.

In such cases, all bookings are therefore firm and final.

Article 6 – Changes to the customer’s circumstances

The customer undertakes to inform the Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’, in writing or by email, of any changes to their circumstances (in particular, a change of address or bank details).

The Category I Tourist Office ‘BEAUNE & PAYS BEAUNOIS’ shall not be held liable for any consequences that the customer and/or third parties may suffer should the customer fail to notify the Category I Tourist OfficeI ‘BEAUNE & PAYS BEAUNOIS’ of any change to their circumstances.

Force majeure: The parties shall not be held liable, nor shall they be deemed to have breached these special terms and conditions of sale, for any delay or failure to perform where the cause of the delay or failure to perform is attributable to a case of force majeure as defined by the case law of the French courts.

Article 7: Confidentiality and protection of personal data

In accordance with the French Data Protection Act of 6 January 1978, the customer has the right to access, rectify and object to the processing of their personal data by contacting the Cat.I “BEAUNE & PAYS BEAUNOIS” at [email protected], specifying “Personal data” as the subject of the email.
