“BEAUNE & PAYS BEAUNOIS”

Article 1

Registered Tourist Offices, within the framework of the law of July 22, 2009, can ensure the reservation and sale of all types of services, leisure and reception of general interest in their area of intervention. They make it easier for the public to find what they are looking for by offering a choice of services.
Tourist Offices are local tourism organizations, made available to service providers and which have signed a mandate agreement with them.
Tourist Offices cannot be held liable for the use of these contracts by third parties or for purposes other than tourism.

Article 2 – Duration of the service

The customer mentioned on the voucher (or ticket) indicating a service of a specified duration may not, under any circumstances, claim any right to remain in the premises at the end of the service.

Article 3 – Responsibility

The Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” which offers services to a customer is the sole interlocutor of this customer and is answerable to him for the performance of the obligations arising from the present conditions of sale. The Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” cannot be held responsible for fortuitous events, cases of force majeure or the actions of any person unrelated to the organization and running of the service.

Article 4 – Reservation

A reservation becomes firm when the full price has been paid to the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” before the date and time shown on the voucher (or ticket).

Article 5 – Voucher

On receipt of the fee for the service, the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” gives the customer two copies of the voucher (or ticket), one copy of which must be given by the customer to the service provider on arrival.

Article 6 – Arrival

The customer must arrive on the day specified and at the times mentioned on the voucher (or ticket).
If this is not possible, he/she undertakes to notify the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS”.
In the event of late arrival or last-minute impediment, the customer must notify the provider whose address and telephone number or e-mail address appear on the purchase ticket.

Article 7 – Cancellation by the customer.

Any cancellation must be notified to the reception department of the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” on + 33 (0)3 80 262 130 or by e-mail billetterie@beaune-tourisme.fr specifying the order number. The customer must obtain a cancellation number confirming the registration of his cancellation.
If the cancellation takes place less than 24 h before the date of the service, 100% of the amount of the order will be retained.
In case of no-show of the customer, 100% of the amount of the order will be retained.

Article 8 – Modification by the service provider or the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” of a substantial element of the service

When, before the scheduled start of the service, the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” is obliged to make a change to one of the essential elements of the service, the purchaser may:
– either cancel the reservation and obtain, without penalty, the deferred reimbursement of the sums paid;
– or accept the change or substitution of places of service proposed by the seller.
Any price reduction will be deducted from any sums still owed by the purchaser and, if the payment already made by the latter exceeds the price of the modified service, the overpayment will be returned to the customer before the service begins.

Article 9 – Inability of the seller to provide the services stipulated in the contract during the course of the service

When, during the course of the service, the seller is unable to provide a preponderant part of the services stipulated in the contract, representing a non-negligible percentage of the price paid by the purchaser, the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS”, without prejudice to any claims for damages, will offer an alternative service to the one agreed upon, and will bear any additional costs incurred. If the service accepted by the purchaser is of inferior quality, the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” will reimburse the difference in price before the end of the service. If the seller is unable to offer a replacement service, or if this is refused by the buyer for valid reasons, the former will pay the latter compensation calculated on the same basis as in the event of cancellation due to the seller.

Article 10 – Cancellation due to the seller

If the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” cancels the service due to the provider before the start of the service, it must inform the buyer before or at the time of departure of the service. The purchaser will be reimbursed, insofar as possible, immediately or at a later date for the sums paid – without any compensation.

Article 11 – Interruption of the service

In the event of interruption of the service by the customer, no reimbursement will be made.

Article 12 – Capacity

The present voucher (or ticket) is established for a precise number of people. If the number of participants exceeds the capacity provided for by the service, the service provider may refuse additional customers.

Article 13 – Transfer of the voucher by the customer

The purchaser may transfer his voucher to a transferee who meets the same conditions as he does to perform the service. In this case, the purchaser must inform the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” before the start of the service.
The transfer of the voucher (ticket) must be made at cost price.
The transferor and the transferee are jointly and severally liable to the vendor for payment of the balance, the price and any additional costs incurred as a result of this transfer.

Article 14 – Insurance

The customer is responsible for all damage arising from his own fault. He is invited to take out a holiday insurance policy to cover these various risks.

Article 15 – Special conditions for services

The special conditions for services resold by the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” are communicated with the voucher (or ticket).
Inadequate numbers of participants may be a valid reason for cancelling certain types of service.
In this case, the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” will refund all sums paid, as far as it is able, immediately or deferred.

Article 16 – Litigation

Any claim relating to a service must be submitted to the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” within 3 days of the start of the service.
Any other complaint relating to a service must be addressed, as soon as possible, by letter, to the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” only competent to issue a decision on disputes.

Any dispute concerning the exclusive application of the present terms and conditions will fall within the exclusive jurisdiction of the courts of the head office of the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” or of the chief town of its department.

Article 17 – Professional civil liability

The Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” has taken out professional liability insurance for local non-profit tourism organizations (article 60 of decree no. 94-490 of June 15, 1994) no. 082509/J with the following company:

Article 18 – Registration

L’Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” is registered with ATOUT France des opérateurs de voyages et de séjours under the number IM021100008.

Article 19: Confidentiality and protection of personal data

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to their personal data, by contacting the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” at billetterie(at)beaune-tourisme.fr and specifying “Personal data” as the subject of the e-mail.

Special conditions for distance selling

Article 1: The order

Any order for services placed online or remotely with the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” implies unreserved acceptance of these special conditions for distance selling. These conditions can be consulted at any time on the www.beaune-tourisme.fr website under the heading “C.G.V”.

Article 2: Terms of performance and delivery

The Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” offers its customers services performed by partner service providers.
The vouchers (or tickets) corresponding to each of the services are sent to the customer by e-mail in PDF format. These vouchers (or tickets) will be requested from the customer by the service provider during the visit. These vouchers (or tickets) are valid for the period and service indicated. In the event of the failure of one or more service providers, the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” undertakes to provide an equivalent service without this giving entitlement to any compensation; if for any reason whatsoever, one of the services booked could not be provided or replaced (in whole or in part) the customer may only claim reimbursement of the service concerned, to the exclusion of all damages and interest.

Article 3 : Payment

Payment for online purchases is made by bank card (Visa, Mastercard, Carte Bleue) via the Paybox System secure payment system https://www.paybox.com/agrements-et-certifications/). E-tickets in PDF format will be sent by e-mail once the order has been validated and payment accepted.

Article 4: Cancellation by the customer

In accordance with the French Consumer Code and the provisions of articles L121-21, the customer has a 14-day cooling-off period from the day of receipt of the e-tickets, without having to give any reason or pay any penalties.
However, in accordance with articles 121-21-8, and as an exception to article L121-21, the customer has no right of withdrawal for leisure activity services that must be provided on a specific date or at a specific time. In this case, all orders are firm and final. All cancellations must be notified to the reception department of the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” on + 33 (0)3 80 262 130 or by e-mail billetterie@beaune-tourisme.fr, specifying the order number. The customer must obtain a cancellation number confirming that the cancellation has been registered.
If the cancellation is made less than 24 hours before the date of the service, 100% of the order amount will be retained.
If the customer fails to show up, 100% of the order amount will be retained.

Article 5 : Disputes

Any claim relating to a service must be submitted to the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” within 3 days of the start of the service. Any other complaint relating to a service must be addressed, as soon as possible, by letter, to the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” only competent to issue a decision on the disputes.
Any dispute relating to the exclusive application of the present general conditions will be of the exclusive competence of the courts of the head office of the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” or of the chief town of its department. Only the French version of these terms and conditions shall be binding for their interpretation.

Article 6 – Modification relating to the customer’s situation

The customer undertakes to inform the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS”, in writing or by e-mail, of any modification concerning his situation (in particular, change of address, bank details,)
The Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” cannot be held responsible for any consequences that the customer, and/or third parties, may suffer in the event that the customer has failed to notify the Tourist Office Cat.I “BEAUNE & PAYS BEAUNOIS” of any change concerning his/her situation.

Force majeure: The parties will not be held responsible, or considered to have failed to comply with these special conditions of sale, for any delay or non-performance, when the cause of the delay or non-performance is linked to a case of force majeure as defined by the case law of the French courts.

Article 7: Confidentiality and protection of personal data

In accordance with the French Data Protection Act of January 6, 1978, customers have the right to access, rectify and object to their personal data, by contacting the Office de Tourisme Cat.I “BEAUNE & PAYS BEAUNOIS” at billetterie(at)beaune-tourisme.fr and specifying “Personal data” as the subject of the e-mail.
