General conditions of sale of the
“BEAUNE & PAYS BEAUNOIS” Tourist Office Cat.I

 

Article 1


Authorised Tourist Offices, under the law of 13 July 1992, can arrange the reservation and sale of all types of services, leisure activities and general interest events in their area of intervention. They serve the public by offering a choice of services.
Tourist Offices are local tourism organisations, available to service providers who are not members and who have entered into a mandate agreement with them.
In no case may the FNOTSI and the Tourist Offices be held liable for the use of these contracts by third parties or for purposes other than tourism.
 

Article 2 – Service duration

The customer mentioned on the voucher (or ticket) indicating a service of a fixed term cannot, under any circumstances, claim any right to remain in the premises at the end of the service.
 

Article 3 - Liabilit

The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I which offers a customer services is the sole organisation that deals with this customer and is answerable thereto for the execution of the obligations resulting from these terms and conditions of sale. The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I cannot be held responsible for fortuitous events, cases of force majeure or because of any person outside the organisation and provision of the service.
 

Article 4 - Reservation

A reservation becomes definitive when the full price has been paid to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I before the date and time limit featuring on the voucher (or ticket).
 

Article 5 - Voucher

As soon as the costs of the service are collected, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I gives the customer two copies of the voucher (or ticket), one copy of which must be given by the customer to the service provider upon arrival.
 

Article 6 - Arrival

The customer must be present on the specified day and at the times mentioned on the voucher (or ticket).
If this is not possible, he/she agrees to inform the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I.
In the event of late arrival or last-minute inconvenience, the customer must inform the service provider whose address and telephone number appear on the fact sheet.
 

Article 7 – Cancellation on the part of the customer

All cancellations must be reported to the reception desk of the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I on + 33 (0)3 80 262 130 or by email at billetterie(at)beaune-tourisme.fr, specifying the order number. The customer must obtain a cancellation number confirming the recording of their cancellation.
Any cancellation of a sale is subject to the payment of cancellation fees corresponding to 20% of the amount of the order.
If cancellation occurs less than 24 hours before the date of the service, 50% of the amount of the order will be retained.
In case of no-show by the customer, 100% of the amount of the order will be retained.
 
 

Article 8 - Modification by the service provider or the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I of a substantial element of the service

When before the scheduled start date of the service, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I is forced to make a modification to one of the main elements of the service, the purchaser can:
                   - either cancel the reservation and obtain, without penalty, the deferred reimbursement of the sums paid;
                   - or accept the modification or substitution of the location of the services offered by the seller.
Any reduction in price is deducted from any sums remaining due by the purchaser and, if the payment already made by the latter exceeds the price of the modified service, the overpayment will be refunded to the customer before the start of the service.
 

Article 9 - Impediment preventing the seller from providing, during the service, the services provided for in the contract

When during the provision of the service, the seller is unable to provide a major part of the services provided for in the contract, representing a significant percentage of the price honoured by the purchaser, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I, without prejudging recourse for claims for any possible damage suffered, will offer a service to replace the planned service, supporting any possible additional price. If the service accepted by the purchaser is of an inferior quality, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I will refund the difference in price before the end of the service. If the seller cannot offer a replacement service, or if it is refused by the purchaser for valid reasons, the former will pay the latter compensation calculated on the same basis as in the case of cancellation by the seller.
 

Article 10 – Cancellation on the part of the seller

When before the start of the service, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I cancels the service on the part of the provider, it must inform the purchaser before or at the time of departure of the service starting. The purchaser will be reimbursed, to the extent possible, immediately or by deferred amounts paid - without any compensation.
 

Article 11 - Interruption of the service

In case of interruption of the service by the customer, there will be no refund.
 

Article 12 – Capacity

This voucher (or ticket) is issued for a specific number of people. If the number of participants exceeds the total capacity provided by the service, the service provider may refuse additional customers.
 

Article 13 - Transfer of the voucher by the customer

The purchaser may transfer his/her voucher to an assignee who fulfils the same conditions as him/her to perform the service. In this case, the purchaser is obliged to inform the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I before the start of the service.
Transfer of the voucher (ticket) must be done at cost price.
The transferor and the assignee are jointly and severally liable vis-à-vis the seller, the payment of the balance, the price as well as any additional costs occasioned by this transfer.
 

Article 14 - Insurance

The customer is responsible for all damages arising from his/her part. He/she is invited to take out a holiday-type insurance contract for these various risks.
 

Article 15 - Special service conditions

The particular conditions of the services sold by the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I are communicated with the voucher (or ticket).
An insufficient number of participants may be a valid reason for cancellation for certain types of services.
In this case, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I refunds all sums paid, so far as possible, immediately or subsequently.
 

Article 16 - Disputes

Any claim relating to a service must be submitted to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I within 3 days from the start of the service.
Any other claim relating to a service must be sent, as soon as possible, by letter to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I, which alone is competent to issue a decision on litigation.
If the disagreement persists, disputes may be submitted to the Quality Department of the National Federation of Tourist Offices and Syndicates, which will endeavour to reach an amicable agreement.
Any dispute concerning the exclusive application of these terms and conditions will be the exclusive jurisdiction of the courts of the head office of the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I or the chief town of its department.
 
Article 17 – Professional civil liability
The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I has taken out professional liability insurance for local non-profit tourism organisations (Article 60 of Decree No. 94-490 of 15 June 1994) No. 082509/J with the company:

Article 18 – Registration
The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I is registered in the ATOUT France register of travel and holiday operators under the number IM021100008.
 

Special conditions for distance selling

 

Article 1: The order

Any online or remote service order to the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I assumes compliance without reservations or restrictions with these special conditions for distance selling. These conditions can be consulted at any time on the website www.beaune-tourisme.fr under the heading "conditions for using the site".
 

Article 2: Terms of execution and delivery

The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I offers its customers services performed by partner service providers.
The vouchers (or tickets) corresponding to each of the services are sent to the customer by e-mail in PDF format. These vouchers (or tickets) will be requested from the customer by the service provider during their visit. These vouchers (or tickets) are valid for the period and services indicated. In the event of the failure of one or more service providers, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I undertakes to provide an equivalent service without giving right to any compensation; if for any reason, any of the services booked could not be provided or replaced (in whole or in part), the customer can only claim reimbursement for the service concerned, excluding any damages or interests.
 

Article 3: Payment

Payment for online purchases is made by bank card (Visa, Mastercard, Carte Bleue) via the Paybox System secure payment system (http://www1.paybox.com/securite.aspx). Electronic PDF tickets are sent by e-mail after validation of the order and acceptance of payment.

Article 4: Cancellation on the part of the customer

In accordance with the Consumer Code and the provisions of Articles L121-21, the customer has, from the date of receipt of the electronic tickets, a withdrawal period of 14 clear days without having to justify reasons or pay penalties.
However, in accordance with articles 121-21-8, and by exception article L121-21, the customer does not have the right of withdrawal for the services of leisure activities that must be provided on a determined date or period. In this case, all orders are firm and final. All cancellations must be reported to the reception desk of the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I on + 33 (0)3 80 262 130 or by email at billetterie(at)beaune-tourisme.fr specifying the order number. The customer must obtain a cancellation number confirming recording of their cancellation.
Beyond the statutory withdrawal period or where the right of withdrawal does not apply, any cancellation of a remote sale is subject to payment of cancellation fees corresponding to 20% of the total amount of the order.
If cancellation occurs less than 24 hours before the date of the service, 50% of the amount of the order will be retained.
In case of no-show by the customer, 100% of the amount of the order will be retained.
 

Article 5: Disputes

Article 6: Changes relating to the customer's situation

The customer agrees to inform, in writing or by e-mail, the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I of any change concerning his or her situation (in particular, change of address, bank details etc).
The "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I cannot be held responsible for any consequences that may be suffered by the customer, and/or third parties, in the event that the customer fails to notify the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I of any change concerning their situation.


Force majeure: The parties will not be held responsible, or considered as having failed in these specific conditions of sale, for any delay or non-performance, when the cause of the delay or non-performance is linked to a case of force majeure as defined by the jurisprudence of the French courts.
 

Article 7: Confidentiality and protection of personal data

In accordance with the law of 6 January 1978 on "Information and Freedoms", the customer has a right to access, rectify and delete his or her personal data, by contacting the "BEAUNE & PAYS BEAUNOIS" Tourist Office Cat.I at billetterie(at)beaune-tourisme.fr and specifying as the subject of the email "Personal data".
